New Delhi: The Supreme Court on Tuesday delivered its much-anticipated judgment on pleas seeking legal validation for same-sex marriage. A five-judge bench had reserved its order on May 11 on a batch of 20 petitions filed by same-sex couples, transgender individuals, and LGBTQ+ activists. The hearing started on April 18. The petitioners had sought a declaration by the top court that the term “marriage” under the Special Marriage Act, 1954, would be read as between “spouse” instead of “man and woman”.
The Central govt had opposed same-sex unions during the hearing, saying that ‘the legislative policy of India has consciously validated a union only between a biological man and a biological woman.’ In May, the govt submitted in the court that it would set up a panel headed by the cabinet secretary to examine administrative steps that could be taken to address “genuine concerns” of same-sex couples.
